Kator, Parks, Weiser & Wright, PLLC, represents the class of women who were required to take the PTF-1, PTF-2, and the FGS and failed to pass the push-up qualification standard at any stage. These fitness tests were required in order to attain a permanent Customs and Border Protection Officer position. The class action alleges that the agency’s push-up tests discriminated against female candidates.

See the EEOC decision certifying the class complaint here.

The EEOC denied a request from the agency to reconsider its decision to certify the class action.
